Dubai off-plan due diligence starts with matching the project and unit in Dubai Land Department (DLD) records, tracing payments to the project escrow account, which holds buyer funds for the development, and checking the signed Sale and Purchase Agreement (SPA). Include the DLD fee in the purchase budget.

Key takeaways
  • Check the developer, project, sales status and unit details against current DLD and Real Estate Regulatory Agency (RERA) records.
  • Match the project escrow account and payment beneficiary to the official project details.
  • Compare the reservation form, draft SPA, payment schedule, unit plan and specifications before committing funds.
  • Use completed projects to assess delivery evidence, and keep observed results separate from projections.
  • Build a dated cash-flow schedule that includes fees, ownership costs and the possibility of delayed handover.
  • For a broader introduction to the purchase process, read M&M’s off-plan guide.

What off-plan buying means and what due diligence can establish

An off-plan property is bought before construction is complete. The buyer relies on the SPA and its incorporated plans and specifications to define what the developer must deliver.

Project registration, escrow and the developer’s statements each address a different part of the purchase. Registration records project details, and escrow sets a route for buyer funds, so assess delivery timing, construction quality and investment prospects as separate questions.

Oqood is the DLD’s off-plan registration record. Check how the sale will be registered and documented, and keep it distinct from the reservation form, which records the unit and initial terms, and the signed SPA, which sets the contractual terms.

Off-plan properties in Dubai is a starting point for seeing opportunities M&M Real Estate curates by location, developer track record and growth potential. Use that shortlist to identify projects for individual checks, not as a substitute for reviewing their documents.

Before paying, make sure you have the reservation form, draft SPA, payment schedule, unit plan, specifications and relevant project-registration details.

Verify the developer, project and sales status first

Start with the developer’s legal identity and licence. Then compare the project name, phase and plot with current official DLD records and the available RERA information, using DLD Project Status or Dubai REST to check the project record.

Match the unit number, building or phase, area and seller in the reservation documents to the official project information. Resolve any difference in writing before paying, because a mismatch can leave uncertainty about which unit or seller the documents cover.

Record the official source and date of each check. This gives you a clear baseline to compare with any later change to the project’s status or details.

For an off-plan sale, establish how the developer will register the transaction through Oqood and which documents you will receive. M&M’s developer profiles can help you review background information, while the project’s current status still needs its own official check.

Keep the source and date beside each checked detail, including the project name, phase, plot, unit and seller.

Confirm escrow and the route every payment will take

Check the project escrow arrangement against official project records. The named beneficiary and account details should correspond to the development, so compare them with the project documents before sending funds.

Verify payment instructions through an official channel you established independently. If an email or message changes the beneficiary or account, pause the transfer and contact the developer through a previously verified route to establish the correct instructions.

Compare the reservation form, SPA, payment schedule and receipts. The amount, due date, construction milestone and receiving account should align across those documents.

Collect and compare the reservation form, draft SPA, payment schedule, unit plan, specifications and project-registration details as one set. This helps you spot a payment or unit detail that appears in one document but conflicts with another.

Keep copies of the verified instructions and payment receipts with the matching project documents.

Assess the developer’s delivery record using completed work

Use completed projects to assess what the developer delivered against its original plans. Compare layouts, finishes and shared facilities with the specifications and sales material used before construction.

Review completion timing, handover condition and how outstanding defects were handled. A site visit can help you assess visible finishes and shared areas, while dated documents and photographs can help distinguish what was delivered from what was first described.

Assess the site as well as the developer. Look at access, surrounding infrastructure and whether the project depends on facilities or later phases that are still planned.

Keep observed evidence separate from projections about future demand or resale potential. Record the basis for each conclusion, such as a completed building you visited or a project feature that remains planned.

Write down which points come from completed work and which depend on future delivery or market conditions.

Read the SPA for unit details, changes and remedies

Match the SPA and its incorporated documents to the agreed reservation details. Check the unit description, area, floor plan, parking and specifications, including which plans or schedules form part of the signed contract.

Read the permitted-variation clauses for changes to layout, area, finishes or facilities. Check how the SPA measures a change and what remedy it provides if the delivered unit differs from the agreed specifications.

Identify the stated completion date, any extension or grace period, delay provisions and available buyer remedies. Use the contract wording when assessing handover timing, since a verbal estimate does not set the SPA terms.

Review cancellation, default and assignment clauses. Note the conditions and costs that apply if you need to cancel, miss a payment or sell before completion.

If a brochure, reservation form, SPA or official project record conflicts, pause the purchase and request a written clarification. Have the agreed correction incorporated into the binding documents before paying.

Stress-test every payment milestone and the full cash requirement

Put each instalment on a dated cash-flow schedule and connect construction-linked payments to their stated milestones. A headline payment-plan split does not show the date on which each amount is due.

Calculate the full cash requirement, including the deposit, instalments, DLD transfer fee, mortgage and registration charges, trustee costs and any contractual charges.

Cash-flow checkWhat to record
Payment milestonesDue date, amount, stated trigger and receiving account for each instalment.
Contractual consequencesLate-payment provisions and the steps the SPA sets out if an instalment is missed.
Completion costsTransaction charges, expected ownership costs and a cash reserve for work around handover.
Income and financeAvailable cash if income falls, finance costs change or a mortgage is delayed.

Test the schedule against delayed construction or handover, a mortgage arriving later than planned and a fall in personal income. If your funds or income are in another currency, include the effect of exchange-rate movements on each payment.

Review the budget and timeline together, including the cash needed around completion. An M&M advisor can go through your budget, timeline and shortlist with you through M&M Real Estate’s contact page.

Budget for ownership and prepare for handover

Compare projected rent with net income after service charges, the fees for maintaining shared areas and building systems, maintenance, insurance, utilities, vacancy and letting costs. A gross yield leaves these costs out, so prepare a unit-level income and expense estimate before relying on a rental projection.

Before handover, arrange an independent inspection where appropriate. Compare the delivered unit with the SPA specifications and agreed plans, then photograph and list defects for submission through the process set out in the contract.

Keep dated records of defect notices, acknowledgements, remedial work and items that remain outstanding. Review the SPA’s defects-liability provisions, which set out how covered defects and notices are handled, and budget for ongoing costs and any immediate work after taking possession.

Keep the inspection report, defect notices and follow-up records together with the signed SPA and handover documents.

What to do before you reserve

For Dubai off-plan due diligence, put the current DLD project record, verified payment instructions, draft SPA and dated cash-flow schedule together before you reserve or transfer funds. Resolve any mismatch in writing, and make sure the clarification appears in the documents that govern the sale.

Frequently asked
Can non-residents buy off-plan property in Dubai?

Eligibility depends on the property’s title structure and buyer requirements. The DLD record identifies the ownership details for the unit being sold.

Can an off-plan property be resold before handover?

It can be possible where the SPA terms and registration status allow an assignment. The transfer may involve developer approval and DLD registration, so the contract’s assignment process determines the documents and steps involved.

Is a mortgage available for an off-plan property in Dubai?

Yes, banks may finance off-plan purchases, subject to their assessment.

Does an off-plan buyer receive a title deed immediately?

No, the buyer receives an Oqood registration record during construction, while the title deed follows completion and final registration with the DLD. Keep the Oqood record with the SPA and payment documents until the final title is issued.
