Dubai off-plan handover delays are assessed against the completion date and extension terms in the signed Sale and Purchase Agreement (SPA). A marketing target or later handover notice gives context, while the SPA sets the contractual process that governs the buyer’s next step. If the contractual date has passed after any valid extension, follow the SPA’s notice process, check the project’s official status and preserve your evidence. Compensation, termination and a refund are not automatic; the available remedy depends on the contract, project status and applicable process.

Key points for a delayed handover
  • Read the SPA’s completion date, definition of completion, grace period and extension clauses together.
  • Use Dubai Land Department (DLD) and Real Estate Regulatory Agency (RERA) records to check the project’s recorded status, and save dated results.
  • Keep a chronological file of notices, payment records, construction updates and correspondence.
  • Review the SPA and get case-specific advice before withholding an instalment or seeking termination.
  • Separate any contractual delay compensation from actual costs, and document how the delay caused each expense.
  • For the buying process and its terms, read the Dubai off-plan guide.

Find the completion date that governs your SPA

The SPA’s contractual completion date is the starting point for assessing a delay. Read the SPA’s definition of completion as well, because it may link completion to a formal notice, practical completion, access to the unit or another contract term.

A launch brochure or sales conversation may give a target date. A later handover notice may give a revised forecast. Neither replaces the date and process set out in the signed SPA unless the contract’s amendment requirements have been followed.

Read the extension and grace-period clauses together. Check what event can trigger an extension, whether the developer must give notice, and whether the SPA sets conditions or requires supporting information.

A standard grace period does not apply to every SPA. A date passing on its own does not set a fixed penalty, cancellation right or refund; the contract’s terms and the project’s circumstances shape the available next steps.

When assessing an off-plan purchase, consider the developer’s delivery record, project registration, payment structure and your ability to manage timing uncertainty alongside location and the investment case. The developer information can support that review; compare it with the project’s own records and the terms in the SPA.

M&M Real Estate’s Premium off-plan villas in Dubai page describes water-body-facing villas sourced with Dubai developers, with opportunities targeting an 18-24-month purchase-to-resale window. That stated investment horizon is separate from the contractual completion date, so read the SPA’s delivery terms when assessing whether the timing fits your plans.

Verify the project’s official status and buyer protections

Use DLD and RERA channels to check recorded project information and raise a concern. Save dated results, case references and written replies, so your record shows what the authority recorded and when.

DLD is Dubai’s land department, and RERA is its real estate regulatory agency. A status enquiry or regulatory complaint does not itself award damages or suspend payments. Start through DLD’s official customer-service or complaint channel and ask which route applies to the project’s recorded status. Provide the project identifiers, SPA and Oqood records, payment receipts, dated chronology, notices and the outcome you seek. Request written acknowledgement or a reference, retain replies and provide any further records requested. If you seek compensation, termination or an enforceable refund, also follow the SPA’s dispute clause and obtain Dubai-specific legal advice: a regulatory complaint and a decision on a contractual remedy are distinct routes.

Check the project’s registration and Oqood as part of your records.

Escrow is a regulated arrangement intended to safeguard project funds under the applicable project rules, while a handover claim concerns the developer’s obligations under the SPA. The account does not itself decide whether the developer breached the contract or guarantee an immediate refund of the buyer’s payments.

Separate an active project from a stalled project and a formally cancelled one. Check the recorded status, because it can affect which administrative, contractual or legal route may be relevant.

  • Active: compare the developer’s current construction information with dated notices and the SPA’s completion terms.
  • Stalled: keep the authority’s recorded information and ask which complaint or case process applies to that project.
  • Formally cancelled: save the cancellation record and review the SPA and official process before deciding what remedy to seek.

Test the developer’s explanation, including force majeure

Compare the developer’s explanation with the SPA’s extension and force majeure wording. A general reference to exceptional circumstances does not establish that the clause applies to the delay in your project.

Ask which event the developer relies on, how that event affected construction or completion, and how the developer calculated the time added to the schedule. Keep the dated explanation and any supporting documents provided.

Dubai off-plan handover delays can involve changing forecasts, construction updates and formal notices. Keep each one in date order, so you can compare the developer’s explanation with the project’s recorded status and the contract’s extension process.

For a buyer comparing developments, off-plan properties in Dubai are curated by M&M based on location, developer credibility and projected return. Developer credibility belongs in the initial review because a buyer needs to assess delivery information alongside the investment case.

An informal assurance or general update changes the SPA only if it follows the contract’s required form and process. Keep the original message, and ask for any proposed change to be issued through the contractual channel.

Preserve evidence and manage instalments carefully

Keep one chronological file for the delay. Include the signed SPA and amendments, payment receipts, dated handover forecasts, formal notices, project-status records and relevant correspondence.

Send concerns through the notice channels named in the SPA, and retain proof of delivery. After a call, send a short follow-up email that records the date, the people involved and what each person said or agreed to do.

If an instalment falls due during a delay, read the payment and dispute clauses before acting. Get case-specific advice before withholding payment, and raise the dispute clearly without assuming that the delay suspends the payment obligation.

Record costs as they arise. Keep invoices, accommodation or rental records and documents showing what steps you took to limit each expense.

Match the remedy and dispute route to the contract and project

The SPA sets out the remedies, notice periods and dispute-resolution process. A missed contractual date starts the assessment; extension clauses, notice requirements and project status shape whether compensation, termination or a refund may be available.

Assess contractual delay compensation separately from a claim for actual costs. Compensation depends on the agreement’s terms, while a claim for expenses needs evidence of the amount and its connection to the delay.

Use the recorded project status and the SPA’s dispute clause to assess whether an administrative complaint, arbitration or court process may apply. Get Dubai-specific legal advice before issuing a termination notice or filing a claim.

Before escalating, prepare a dated chronology that sets out the contractual date, applicable extensions, notices sent, the developer’s response and the remedy sought. This gives an adviser or authority a clear account of the dispute.

Document the financial impact of the delay

Create a separate record for each cost you may claim. Record its date, amount, supporting document and a clear explanation of how the delay caused it.

Keep actual expenses, such as temporary accommodation or additional financing costs, separate from any compensation provided for in the SPA. Each expense needs its own contractual and evidential basis; the fact that a cost arose during the delay does not establish that it is recoverable.

Record steps taken to limit the cost, such as alternatives you considered and the reason for your choice. Keep the related quotes, bookings or other dated records with the expense file.

Projected rent or resale proceeds are not an incurred expense. Include them in a claim only where there is evidence and a clear connection between the delay and the loss being claimed.

Prepare for inspection and completion if handover proceeds

Keep the handover notice and final payment statement. Reconcile the statement against the SPA and your receipts before making the final payment, and ask the developer to explain any difference in writing.

Arrange a careful inspection and record each defect with dated photographs and a written description. Keep the snagging list, the developer’s replies and any agreed repair dates together.

Track access arrangements, repair appointments and unresolved defects against the handover timeline. This keeps the inspection record connected to the delay and to the developer’s response.

Track the documents required for title or registration completion. Physical possession and completion of the relevant ownership record are separate steps, so retain the documents for each.

What to do now

Start with the SPA’s completion date and extension clauses. Then save the latest DLD or RERA project record, organise your notices and payment receipts, and prepare a dated list of the costs or remedy you want to discuss.

Frequently asked
Is it worth buying off-plan property in Dubai if handover dates can change?

It can suit a buyer whose investment plan can accommodate a change in timing and whose funding remains workable under the SPA’s payment schedule. Compare that flexibility with the location, developer and project information before deciding.

Can I sell or assign my SPA while a handover delay is unresolved?

Assignment depends on the SPA and the applicable registration process. Ask the developer for its written requirements and obtain advice on the transfer steps before agreeing to sell or assign the contract.

How can I handle a delayed handover if I live outside the UAE?

Ask the developer to send notices and project updates through a written channel you can access from abroad, and keep copies in your chronology. A Dubai-based lawyer can review formal notices and advise on any local steps that require representation.

Can mortgage arrangements affect what I need to do when a delayed property is ready for handover?

Yes. A revised handover date can affect the timing of a lender’s approval, valuation and release of funds, so ask your bank how its conditions fit the updated schedule. Ask the lender to confirm in writing which conditions remain before funds are released.
